The Current State of US Craft Beer & Intellectual Property

Over the past few years, the number of craft brewers in the United States has skyrocketed (see infographic below). As a result, the number of trademark disputes and intellectual property investigations related to new beer brands in the marketplace have been on the rise as well. From the kitschy to the inspired, the beer brand names keep on coming like the tap of a bottomless keg.

Some disputes are true David and Goliath tales between microbreweries versus the big boys of beer. I’m sure most are now familiar with the well-established Bell’s going after a small NC company owned and operated by a mom ‘n pop ale shop. Many other scraps are about the little guys going at each other to stake claim to a cool name. But the bottom line here is whether David v. Goliath or David v. David, all brands need to protect their intellectual property.
