New York Court Enters Final Order on Red Sole Shoe Case
December 27, 2012 — Marksmen, a worldwide leader in brand protection services, was tapped earlier this year by David H. Bernstein of Debevoise & Plimpton LLP, outside counsel to Yves Saint Laurent to leverage the Marksmen eBeagle® monitoring service in scouring the Web for red soles on women’s high-fashion shoes. The evidence gathered by Marksmen assisted in the response to a lawsuit brought by Christian Louboutin in which it claimed to have the exclusive right to use the color red on these kind of shoes and took exception to Yves Saint Laurent using a “nearly identical” red on the sole of its monochromatic, all-red shoes.
After YSL’s conclusive victory in defeating trademark infringement and counterfeiting accusations by Christian Louboutin, the Court today issued its final order dismissing the lawsuit. In the order, Louboutin has acknowledged that it has no further claims in this case against YSL and also confirmed that YSL is entitled to continue to sell its unique and famous monochromatic red shoes.
